Lyngo Terms and Condition 11292018
1.1 APPROPRIATE APPEARANCE AND CONDUCT
Instructor shall conduct all communications with students, and perform services in accordance with the following conditions:
- (a) Maintain a positive and professional appearance.
- (b) Avoid inappropriate/unnecessary conduct during classes:
- (i) No foul language or actions.
- (ii) No fraternizing with students, or communications with students outside the virtual classroom.
- (iv) If the background or environment where you are teaching is not appropriate, we may ask you to change locations or use a green screen to suit.
- **Solicitation of any student on any individual basis will result in immediate termination.
2.1 SCHEDULING AND CLASS TIMES
- (a) Will be handled through our online scheduling site.
- (b) Virtual classes are held Monday to Sunday (Japan time G.M.T.+9):
- (c) Time Off Requests - You may request as much time off as you like using Time Off Request function online. However, requests must be made at least 17 days prior to the Monday of the week of your time-off.
- (d) To keep up quality of service to the students, tardiness/no shows/last minute cancellations by the instructor will be recorded and may affect future scheduling:
- (i) Instructors are required to confirm their schedule by checking on the supplied scheduling website.
- (ii) Instructors who receive disagreeable evaluations will be initially coached – and are subject to further coaching if the negative evaluations persist.
- (iii) Perpetual Internet/computer issues will result in removal from the schedule until they are resolved.
- (iv) Keep your availability current and inform management when your availability changes. Hours will be assigned according to the availability on our online scheduling system.
3.1 CONTACTS
- (a) All Instructors are required to have at least two forms of communication in case of emergencies:
- (i) Cell Phone/Land Line Communication is paramount.
- (ii) Slack and Email are acceptable in addition.
4.1 PAYMENT FOR SERVICES
- (a) Instructors acknowledge that they are working as Independent Contractors, and not as employees of Lyngo or Lyngo clients.
- (b) Standard payment for Instructors is the amount discussed during earlier interviews. (c) In the case of a student no-show, instructors will be paid for a full lesson.
- (i) In lieu of the regular classes Instructor Work on assignments assigned by Lyngo Staff.
- (d) Payments will be deposited to Instructor's PayPal or other authorized account in Japanese Yen on the 15th and the last business day of each month. If either falls on a weekend or holiday, payment will be made on the next business day.
- (e) Payments on the 15th will be made for services provided from the 26th - 10th, and payments made on the last business day of the month will be made for services provided from the 11th - 25th.
- (f) Instructors shall be responsible for exchange rates, transfer, and/or other fees charged by PayPal or other electronic funds services.
- (g) Any costs incurred for equipment, or services required to perform instruction (computer, Internet, program, etc.) shall be borne by the Instructor. * Please note, because of Japanese Standard Accounting Requirements, your payment will be rounded down to the nearest Yen (¥).
5.1 WITHHOLDING TAX REQUIREMENT
- (a) Any necessary taxes/withholdings will be discussed directly with the Instructor depending on the country/state you live in. Lyngo will keep all Instructors updated if there are changes in the withholding requirements that may affect your future payments.
- (b) As an Independent Contractor, Instructor will be responsible for any taxes as required by your Country of residence. Proof of payment for services rendered will be provided by Lyngo for Instructor to submit to the proper Tax Agency.
- (c) 10.21% will be withheld from Japanese Citizens residing in Japan as required by tax laws
